Wrongful Death
Whereas most personal injury cases are brought directly by the person
who was injured due to the negligence of another, wrongful death cases
are unique in that they are brought by the immediate family members
of the deceased. Under Pennsylvania law, specifically, the Pennsylvania
Survival Act, the estate of the deceased may recover as damages amounts
that the deceased individual would have earned if he or she had survived,
medical expenses, property damage, expenses associated with administering
the estate, medical bills, funeral expenses, and for any pain and
suffering the deceased individual endured prior to death, as well
as punitive damages under extreme circumstances. In addition, the
deceased individual’s spouse, his or her children, and his or
her parents may recover for their own pain and suffering.
