Illegal Pass

Attempting to pass another driver when passing is prohibited is illegal. Crossing over solid yellow lines into the lane of oncoming traffic to pass another driver is an example of an illegal pass.

Rise In Reckless Driving Behavior

Since 2020, there has been a shocking increase in reckless and dangerous driving behavior. Speeding, distracted driving, driving under the influence, and more are all on the rise. Accordingly, traffic injuries and deaths are also on the rise. Despite vehicles being safer, the human body is still fragile. Dangerous driving behavior can lead to catastrophic injuries and even death.

Off-Duty State Trooper Makes Illegal Pass

In February of 2023, an off-duty Pennsylvania state police officer was in a rush to get to work that night. Eyewitnesses state he was tailgating and driving dangerously. The off-duty trooper rounded a turn, nearing a passing zone while following too closely to the car in front of him. He was not in a passing zone, but he knew there was a passing zone farther ahead. The trooper decided to cross the double-yellow lines and illegally pass the car in front of him.

There was a dip in the road ahead. An oncoming vehicle was in the dip, but the off-duty officer did not see it. As he raced to illegally pass one car, he drove into the oncoming vehicle. Everyone survived the crash, but the other driver’s vehicle caught fire. She was trapped inside.

The fire quickly engulfed her vehicle as she screamed for help and honked her horn. Eyewitnesses state the woman was screaming for help and honking her horn for about 90 seconds. The eyewitnesses were unable to help the woman and she died of fire-related injuries.

Criminal Charges Against The Officer

In this situation, the off-duty officer faces criminal charges for their actions. A police investigation determined the actions of the off-duty trooper were “reckless or grossly negligent and caused the death of (the other driver).”

I can’t even fathom how an officer charged with protecting public safety would do something so dangerous. This off-duty officer faces several criminal charges in this crash including vehicular homicide. In a hearing, the judge stated how terrible the situation is because it was entirely preventable. The judge continued to state that we must all remember to practice patience and abide by the laws of the Vehicular Code because, otherwise, we are capable of causing irreparable harm.

Wrongful Death Claims

The other driver was a mother of three and a beloved schoolteacher. She cannot be replaced. Her family and community must now carry on without her. However, her family would be able to file a wrongful death claim against this off-duty trooper.

No amount of money can replace a lost loved one. However, a wrongful death claim can help surviving family members recover money for medical and funeral expenses. A claim can also help compensate for the loss of income and the companionship of that irreplaceable loved one. Finally, a wrongful death claim can help bring justice against dangerous drivers like this.
